Defective product claims involve defectively designed or manufactured products; products that do not live up to their respective warranties or guarantees; products that cause injury during normal use, and products that have unclear, incorrect, or incomplete instructions or warnings concerning their use and therefore cause injury or damage.
Courts have held that there are three separate types of defects, namely, design defects, manufacturing defects, and marketing defects. Design defects are present in a product when some aspect of the product’s design is inherently dangerous. Manufacturing defects occur in the course of a product’s assembly. Marketing defects can occur due to improper labeling, insufficient instructions, or inadequate safety warnings.
